Prosecutorial misconduct is defined as the use of deceptive, illegal or reprehensible methods used by a prosecutor, to attempt to persuade either the court or the jury.

As the United States Supreme Court has noted, the prosecutor represents “a sovereignty whose obligation to govern impartially is as compelling as its obligation to govern at all; and whose interest, therefore, in a criminal prosecution is not that it shall win a case, but that justice shall be done.” (Berger v. United States (1935) 295 U.S. 78, 88 [55 S.Ct. 629, 633; 79 L.Ed. 1314, 1321].)

An excellent case of prosecutorial misconduct would be that when politics comes into play. Gary Cobb, a "despicable" democrat and Assistant District Attorney in Travis County (Austin) Texas, decided to play partisan politics, and through his reprehensible "gestapo" tactics, prosecuted Tom Delay, a Republican, for far less "crimes" than democrats such as Charlie Rangel, Maxine Waters, or Eric "the RACIST" Holder who should be INDICTED for his racist failure to prosecute Samir Shabazz.

And now, Eric Holder should be indicted for his CRIMINAL actions in the "Fast and Furious" scandal that has cost the life of an American ATF Agent, and many others in Mexico. One of these CRIMINAL acts by Eric Holder includes his COVERUP of the crimes committed by him, the Attorney General's office and now Barack Hussein Obama.

For those that do not know, Brian Terry, a U.S. Border Patrol Agent, was murdered with a gun used in the "gun-running" and "Gunwalker Scandal" which was orchestrated and led by Eric Holder, the U.S. Attorney General's Office, the ATF (Bureau of Alcohol, Tobacco, Firearms and Explosives). Eric Holder and Kenneth Melson, the former head of ATF, along with U.S. Attorneys in Arizona; Emory Hurley and Dennis Burke are believed to be leading this coverup of Operation Fast and Furious - which now leads to the White House and Barack Hussein Obama. The coverup began the same day that Brian Terry was murdered.

Looks like Obama has a "Watergate" cover-up scandal to contend with on top of everything else. Like everything else this DOOFUS touches, he will probably screw-up his own coverup and scandal and get impeached.

It's time we take our country back from these radical left-wing extremists and National Socialists!

Prosecutorial discretion, also known as "selective prosecution" and "selective enforcement" is considered by some to be a politically abusive "hammer" and abuse of power.

Prosecutorial discretion allows prosecutors to select the laws they want to enforce, and not enforce other laws, depending on who the defendant is. Such as the case of Gary Cobb, a prosecutor who selected Tom DeLay, a Republican, who Cobb decided to prosecute for a political "crime" while overlooking Democrats guilty of more serious political crimes.
